Economists have long argued that environmental regulation should rely more on economic incentives and less on direct control through uniform regulatory standards. This study is intended to explore the various political, administrative, legal, and economic issues involved in the design and the implementation of incentive-based alternatives to traditional regulatory ('command and control') devices---alternatives such as subsidies, emission/effluent charges, and transferable discharge permits (marketable emission permits). The goal of this book is to suggest a feasible proposal for incorporating economic incentives into Taiwan's extant regulatory scheme, based on the American experience in implementing its regulatory approach and its efforts to explore economic incentive theories over the past two decades. After a delineation of the general state of affairs and governmental structure, as well as the current state of and prospects for environmental law and policy in Taiwan, the author concludes that, given the absence of any strong tradition of a command-and-control regulatory scheme, some version of an incentive-based system would not only be desirable but the most politically feasible to implement.
